LICENSING IMAGES
This Question & Answer section covers the following topics:
If an image is required for personal reasons, e.g. to print and frame at home or give as a personal gift, then the buyer does not generally require a release. If an image is to be used for educational or editorial purposes, e.g. magazine article, textbook, newspaper, then the buyer does not generally require a release. If however, the image is to be used specifically for advertising, a model or property release may be required. Recognisable individuals, property or objects should not be associated with a product or promotional campaign without first obtaining written consent, either from the individuals or from the owners of the buildings, possessions, objects, logos etc., featured within the image. Releases are the responsibility of the publisher & fall into two categories: Model Release - refers to a recognisable person or persons within an image. Property Release - refers to recognisable objects & items owned by individuals or companies, e.g. buildings, possessions, vehicles, artwork, logos, etc., within an image. Images used for front covers of books or magazines will generally need to be covered by relevant releases as they are seen as a form of advertising for the publication. The buyer will need to assess whether the proposed use for the image requires a release or not. If an image already has a release in place, there is a note to this effect on the Hi-Res preview page. Otherwise, the buyer must assume that all images displayed within www.melvinbourne.com do not have model or property releases in place.
Images are licensed to the buyer as opposed to being purchased outright. There are three options when licensing an image from www.melvinbourne.com:
Single Print Image Licence - allows the buyer to arrange for the printing & finishing of the image by themselves or via a professional printer.
Commercial Image Licence - allows the buyer to use the image for hardcopy publications, website applications, multi-media presentations, promotions & advertising purposes.
Exclusive Image Licence - allows the buyer to use the image for hardcopy publications, website applications, multi-media presentations, promotions & advertising purposes.
General Conditions - the following applies to all licenses:
